Watercourse Way Release and Waiver of Liability I understand and acknowledge that my use of the hot tub, sauna, or steam room facilities or massage, spa or facial services, like other exercise and athletic activity, carries with it certain inherent dangers and risks that no amount of care, caution, instruction or expertise can eliminate, and that there are possibilities of injury and other complications which may result from such use or services. I agree and assume full responsibility for any and all risks associated with my use of the hot tub, sauna, or steam room facilities or massage, spa or facial services, including but not limited to any injury to my person or property, including death, caused by conditions, events or occurrences of any kind of nature arising out of or resulting from my use of the hot tub, sauna, or steam room facilities or the massage, spa or facial services or products. I understand and acknowledge that it is solely my responsibility to consult with a physician prior to my use of the hot tub, sauna, or steam room facilities or the massage, spa or facial services to ensure that I am physically able to use the hot tub, sauna, or steam room facilities or receive massage, spa or facial services. I acknowledge and agree that if I have any medical or physical condition, including being pregnant or having a compromised immune system, which may be impacted or worsened by the use of the hot tub, sauna, or steam room facilities or by receiving massage, spa or facial services, I have confirmed with my physician that I can safely use the facilities and/or receive the services with my condition. I also acknowledge that the likelihood of such risks occurring varies from individual to individual, and I warrant and represent to Watercourse Way that I am in suitable physical condition to use the hot tub, sauna, or steam room facilities or the massage, spa or facial services, do not have any medical conditions or health issues that interfere with my ability to safely use the hot tub, sauna, or steam room facilities or receive a massage, spa or facial service and that Watercourse Way will not undertake any responsibility to determine whether I am medically or physically able to use the hot tub, sauna, or steam room facilities or receive a massage, spa or facial safely. I acknowledge and agree that if I am pregnant or have any other medical or physical condition that may be impacted by a massage, spa or facial service, before I receive any massage, spa or facial service, I will inform my therapist of my pregnancy or medical or physical condition so that the necessary safeguards and adjustments can be implemented. I understand and acknowledge that to protect the safety of Watercourse Way’s customers and staff, I must not use the hot tub, sauna, or steam room facilities or the massage, spa or facial services if I have any infectious illness or disease, infection, rash, abrasion, cut, open wound or sore that may come into contact with the water, the benches, the tubs, the massage tables, equipment and/or the massage or facial therapist. I warrant and represent to Watercourse Way that I have no such medical conditions or health issues that may pose a safety or health risk to myself or to Watercourse Way’s customers or staff though my use of the hot tub, sauna, or steam room facilities or by receiving a massage, spa or facial service. In consideration for my use of the hot tub, sauna, or steam room facilities or receipt of massage, spa or facial services, I hereby release Watercourse Way and its officers, directors, employees, agents and outside consultants from any liability for any injury, illness, personal property damage or other harm which I may sustain as a result of my use of the hot tub, sauna, or steam room facilities or massage, spa or facial services. I understand that this release applies to myself and my personal representatives, heirs and assigns. I agree to forever release, protect, indemnify, covenant not to sue and hold harmless Watercourse Way and its officers, directors, employees, agents and outside consultants from any and all liabilities, claims damages, losses, causes of action, judgments, costs, and expenses, including but not limited to attorneys’ fees, as a result of any injury or death resulting from the use of the hot tub, sauna, or steam room facilities or the receipt of massage, spa or facial services. This is intended to release all such claims. I understand that all Watercourse Way therapists are certified by the California Massage Therapy Council, https://www.camtc.org/. I also understand and agree that all massage, spa and facial sessions are non-sexual in nature and both the therapist and I must refrain from any requests, statements, comments or conduct that might be construed as being sexual in nature or offensive or harassing for any reason. I further understand and agree that any sexual, harassing, or offensive requests, statements, comments or conduct by either the therapist or the customer should be reported to Watercourse Way management immediately and the massage, spa or facial service should be stopped, with a full refund. I understand and agree that if I make or engage in any requests, statements, comments or conduct that might be construed as being sexual in nature, offensive or harassing for any reason or make or engage in any other inappropriate requests, comments or conduct, and the massage, spa or facial services will be stopped immediately, my conduct will be reported to management and are stopped, I will not receive a refund. I also understand and agree that my inappropriate conduct may be reported to the appropriate legal authorities and will result in me no longer being able to access and use Watercourse Way’s facilities and services. I understand and agree that if I believe that my massage, spa or facial session is causing me physical pain or discomfort, is not progressing satisfactorily or if I am dissatisfied with the service I am receiving, for whatever reason, I must stop the massage, spa or facial service immediately so that the underlying issue can be addressed and/or remedied. I represent and acknowledge that I have read this Release and Waiver of Liability and fully understand its contents. I voluntarily accept and agree to the terms and conditions stated above.
